Hi, I don't think I've seen such a fly - but it's maybe an ephydrid after all. Around 3 mm, by small pond, E-Hungary, April.

I don't think it's Athyroglossa - see http://www.dipter...ad_id=4664 for a typical example of that. This looks much more like Ditrichophora.
