I agree with Stéphane. We have two genus in Europe: Ditomyia and Symmerus. Yours looks like Symmerus sp. Beware this family was before in Ditomyiinae in Mycetophilidae! As like the mycetophilids, these flies have strong spurs in tibiae. The wing venation leads me to Ditomyiidae. And R4 is not much longer than R4+5, I think... which points us to Symmerus
