Small strange looking fly

Hello al,
I wonder if anyone can ID this small and strange looking (at least to me) fly. It's no more than 4mm long.
Photo taken 2 november 2008 on a wooden railing surrounding a pond.

Phoridae. As far as I know, impossible to get an ID from pictures. Hard even with pinned specimens.
