Small black fly

Hi,

I would like to name this very small fly photographed last year, August in Asturias (Spain).
Puerto de San Lorenzo, 1400m asl.
Length about 3mm.
Any idea of the family/genus?

This is a Hymenopteran I think...... not a fly
