Is this a Phoridae sp. and male or female?

This 2-3mm fly was actively running around on top of a wild raspberry leaf, then would suddenly stop and appear to eat something from the leaf.
In dense undergrowth 5m from a stream, Jarplunder Au.

Phoridae. I also see these pitch black Phorids in and around my garden.

These pitch black phorids with the rather short, wide head usually turn out to be Phora sp.
