long antenna with segments that is'nt differentiated -> Nematocera not Empidoid.

It is definitely
Sylvicola and the species is either
cinctus or
fenestralis.

These two very similar species cannot be distinguished externally, the genitalia are to be examined (see
http://www.online...p?key_no=1). So the best photos won't help :|.
