I thought it looked like Drosophilidae, but I don't see any orbital bristles that point forward, so Lauxaniidae? & the size fits Lauxaniid better.
19 June 2009, West Virginia, USA, in an open area, elevation 330 meters. Length 5.4 mm to apex of wing.

Yes, Lauxaniidae. This is a species of Poecilolycia - probably P. vittata.
