Could this orange fly with spotted wings be a Pallopteridae ?

found in Loire-atlantique, western France, on July 12 2010.

I agree with Opomyza, but are you sure its florum, Nikita? I dont have my opomyzid papers here, but this looks like something else to me.

The costal margin is not dark beyond R1, and I can see any spots along R4+5 - so I would say O. florum. I would be very interested if one could argue otherwise?
