Well according to my key vein tp without brownish fringe only in fuscula.

Well, in Chandler 1987 (The families Diastatidae and Campichoetidae (Diptera, Drosophiloidea) with a revision of Palaearctic and Nepalese species of Diastata Meigen) it says for D. costata: Cross-vein dm-cu not infuscated.

Now I think that D. vagans is also possible if we accept that crossvein dm-cu is strongly infuscated and brown costal border reaches the tip of R4+5.
