identified as Symmerus ( S. Lebrun)

I agree with Stéphane. We have two genus in Europe: Ditomyia and Symmerus. Yours looks like Symmerus sp.
Beware this family was before in Ditomyiinae in Mycetophilidae! :) As like the mycetophilids, these flies have strong spurs in tibiae. ;)
The wing venation leads me to Ditomyiidae. ;) And R4 is not much longer than R4+5, I think... which points us to Symmerus
