it could be Heleomyzidae, but I am not sure from this photo.

I think this is eiter Scathophagidae or Anthomyiidae. Since it is not from a sea-shore I would go for Scathophagidae. I do not think this is an acalyptrate fly, the legs are too bristily, too strong suture on the thorax etc.
