I was hoping an ID might be possible with this picture, I don't believe I have any photos of the wings but I will check later today. Others have suggested it may be
Muscidae or
Anthomyiidae.
This fly was found on October 8, 2015 around 3:30pm near a small man-made pond in Victoria, BC, Canada.

Possibly
Hylemya alcathoe, which seems to be very common along the west coast. This based on plumose arista and red legs. I am not with my books today.
