The black hind legs would rule out flavipennis. Females of D. sudetica and rufipes can not be separated from each other from a picture. Occipital bristles are no sure character. D rufipes is most common in NW Europe. cf

Frons' prophile is quite useful to distinguish the two species. Not easy to spot but not impossible. And if you enlarge the picture, as I've just done, you'll find that this frons is matching with
D. rufipes.
Yes,
flavipennis'legs are not dark.
