Hi, some weeks ago I observed many of these swarming on an oak tree. Has anyone got an idea?

Have you tried keying this out with Menzel's 'Revision der paläarktischen Trauermücken'? You can download the original dissertation from here.
It will take you at least to the correct genus and from there, possibly to subgenus and species-group.

Your pictures are excellent but it would help to see a mount of a wing and also it would be best to try to avoid compression of the hypopygium.
