 I suppose this 3 mm fly is some Elachiptera.
With blackish body, yellow legs, yellow antenna with black arista could eventually species be possible to tell?

 Elachiptera sp. (Chloropidae, Oscinellinae), probably E. tuberculifera (Corti, 1909), but the tip of the scutellum cannot exactly be seen. E. tuberculifera possesses short apical and lateral projections on the scutellum which carry the apical and lateral scutellars. The species is the 2nd abundant Central European E. species after E. cornuta. The adults overwinter and are early on the wing from the first week of March onwards. 310 articles deal with this species with phytosaprophagous larvae,
